참으로 한참동안 많은 분들을 뵙지 못하고 지내왔습니다. 이제 조심스럽게 세상이 기지개를 켜네요. 코로나로 인해 오래 미루어졌던 학생들의 등교가 확대되면 층간소음 민원도 줄어들겠지요. 이번 호는 <외국인을 위한 한국에서의 공동주택 생활 안내> 시리즈 5편 ‘관리주체의 동의기준’입니다.

Consent Criteria of Management Entity(관리주체의 동의기준)

Occupants, etc. shall obtain consent from the management entity in any of the following cases according to Article 18 of Multi-Family Housing Management Act and Article 19 of Enforcement Decree of the Act. 공동주택관리법과 시행령 제19조에 따라 입주자등은 다음 각 호의 어느 하나에 해당하는 행위를 하려는 경우에는 관리주체의 동의를 받아야 합니다

1. Minor acts under Article 35 of the Act (replacement of the same size (color) or shape as the structure and equipment inside the house) is open to our consent. 공동주택관리법 제35조에 따른 경미한 행위(주택내부의 구조물과 설비를 같은 규격(색상)이나 모양 교체)행위는 동의 가능합니다.
For example, Replacement of exterior window frames, door frames, and handrails, or intelligent home network facilities, or plumbing facilities such as water supply and drainage pipes 예를 들면, 외부 창틀, 문틀, 난간 또는 지능형 홈 네트워크 설비의 교체, 또는 급·배수관 등 배관설비 교체.

2. Interfering with passage, evacuation and fire-fighting by stacking up goods in communal areas to the extent not violating the relevant fire law is open to our consent. 관련 소방법에 위배되지 아니하는 범위에서 공용부분에 물건을 적재해 통행·피난 및 소방을 방해하는 행위는 동의 가능합니다.

3. Attaching advertisements, signs to apartments requires our consent. 공동주택에 광고물·표지물을 부착하는 것은 우리의 동의가 필요합니다.

4. Raising animals or pets (Guide dogs for the disabled are excluded) is an act that requires our consent and other occupants’ consent. 가축이나 애완동물 등(장애인 보조견은 제외한다)을 기르는 것은 다른 입주자등과 우리의 동의를 요하는 행위입니다.
The same consent requirements apply to private tutoring within the household (piano, dormitory, study room, or daycare centers, etc.). 세대내 과외(피아노, 합숙소, 공부방, 어린이집 등)에도 같은 동의요건이 적용됩니다.
Using broadcasting equipment, etc. requires our consent. 소음과 관련돼, 방송시설 등을 사용하는 것은 우리의 동의를 필요로 합니다.

In the case of acts requiring consent from occupants, etc., you should obtain written consent from a majority of occupants, etc. residing in the same stairway or corridor. 입주자등의 동의를 요하는 행위의 경우, 당신은 같은 계단 통로나 같은 복도에 거주하는 입주자등의 과반수 서면동의를 받아야 합니다.
In addition, the consent of neighboring households directly affected (including direct upper and lower floors) must be obtained. 직접적인 피해를 받는 인접세대(직상하층 포함)의 동의는 반드시 받아야 합니다.

5. In particular, our consent is needed to install protrusions on the balcony railings or outer walls of apartments. 공동주택의 발코니 난간 또는 외벽에 돌출물을 설치하는 행위는 특히 우리의 동의가 필요합니다.
At this time, you must submit a pledge for the responsibility for the safety accident caused by the installation and it should be safe, sound and fine view. 이때는 반드시 안전사고 책임에 대한 서약서를 제출하여야 하고, 안전, 소음 및 미관에 지장이 없어야 합니다.
The same rule applies to hammering nails or drilling holes to install protrusions on outer walls (concrete walls). 외벽(콘크리트 벽)에 돌출물을 설치하기 위해 못을 박거나 구멍을 뚫는 행위도 같은 규칙이 적용됩니다.

6. Attaching a RFID tag(a radio-frequency identification device) around an outlet for using mobile chargers for electric cars requires our consent. 전기자동차의 이동형 충전기를 이용하기 위한 차량무선인식장치 전자태그(RFID tag)를 콘센트 주위에 부착하는 행위는 우리의 동의가 필요합니다.

7. Accessing an electrical room, mechanical room, and septic tank facility, etc. requires our consent. 전기실·기계실·정화조 시설 등에 출입하는 행위는 우리의 동의가 필요합니다.

8. Using products that grind food waste and discharge it into indoor pipes is prohibited. 음식물쓰레기를 분쇄해 옥내배관으로 배출하는 제품의 사용은 금지돼 있습니다.

9. It is prohibited, generally, to use as non-temporary parking lots of a 2.5-ton or more freight car or a 16-seater or more van. 아파트마다 다르지만 보통 2.5톤 이상의 화물자동차 또는 16인승 이상의 승합자동차 등이 차고지로 사용하는 행위도 금지돼 있습니다.
