What’s Management Rules?
관리규약이란 무엇인가?

1. Definition 정의
「Management Rules」 means rules of autonomy prescribed by occupants, etc.¹) pursuant to Article 18 of 『Multi-Family Housing Management Act』. 관리규약이란 공동주택관리법 제18조에 따라 입주자등이 정하는 자치규약이다.

2. Purpose 목적
To protect occupants, etc. and keep orderly residential life, 「Management Rules」 is prescribing matters concerning the management and using of multi-family housing. 입주자등의 보호와 주거생활의 질서유지를 위해, 관리규약은 공동주택의 관리 또는 사용에 필요한 사항을 규정하고 있다.

3. Range of Application 적용 범위
① 「Management Rules」 applies to residential building, facilities and welfare facilities occupants’ joint ownership, and the land in ‘○○APT’. 이 관리규약은 ○○아파트 내의 공동주택, 입주자의 공동소유인 부대시설 및 복리시설, 그리고 그 대지에 적용된다.

4. The Legal Basis of 「Management Rules」 관리규약의 법적 근거
「Management rules」 is made under Article 18 of the 『Multi-Family Housing Management Act』 and Article 19 of 『Enforcement Decree of The Act』. 이 관리규약은 공동주택관리법 제18조와 같은 법 시행령 제19조에 의거해 만들어졌다.

5. Preparation and Application of 『The Standing Rules』준칙의 마련과 적용
To serve as criteria when 「Management rules」 is legislated or revised,「Standing Rules of Management Rules」 is established by Mayor/Do Governor as prescribed by Presidential Decree. 관리규약이 제정 또는 개정될 때에 준거로 삼도록 하기 위해, 관리규약의 준칙은, 대통령령으로 정하는 바에 따라 시·도지사에 의해 만들어진다.

6. Legislating 「Management Rules」 관리규약의 제정
The first 「Management Rules」  shall be legislated by business entity(the cosnstructon contractor) according to the 「Standing Rules of Management Rules」 and suggested. 최초로 제정되는 공동주택 관리규약은, 사업주체가 준칙에 따라 작성하여 제안하는 것이다.

7. Amending 「Management Rules」 관리규약의 개정
① 「Management Rules」 is amended by reference to 「standing rules」. 관리규약은 관리규약의 준칙을 참조하여 개정된다.
② And the legislating or amendment is decided by the majority agreement of all occupants, etc. 제정과 개정은 전체 입주자등의 과반수 찬성으로 결정된다.
③ When 「Management rules」 violates the relevant laws, the violated part is ineffective. 공동주택관리규약이 관계법령에 위반될 때, 그 위반된 부분은 효력이 없는 것이다.

8. Obligations to obey 「Management Rules」, ect. 규약 등의 준수 의무
To keep communal life smoothly, occupants, etc. should obey 「Management Rules」 and other regulations decided by council of occupants’ representatives. 입주자 등은 원활한 공동생활 유지를 위하여 관리규약과 입주자대표회의에서 제정한 규정들을 준수하여야 한다.

9. The Effectiveness of 「Management Rules」 규약의 효력
① 「Management Rules」 shall also have an effect on those who succeed to the position of occupants, etc. (including a person who acquires it through an auction). 관리규약은 입주자등의 지위를 승계한 사람(경매 통해 취득한 자 포함)에 대해도 그 효력이 있다. 
② Regarding using the multi-family housing, 「Management Rules」 has the same force to the user²) as the occupant³). 공동주택의 사용에 관해 이 규약은 사용자에 대하여도 입주자와 동일한 구속력을 지닌다.
